These general terms and conditions of sale will apply to all orders for products and/or services requested by the Customer (hereinafter, “the Customer”) through the website www.gimasur.es (hereinafter, “www.gimasur.es”, owned by GIMASUR AMBIENTAL, S.L. with registered office at AVDA. LOS ÁNGELES, 19, 1G, 18300, LOJA(GRANADA) and Tax ID: B19602523
Any order placed on www.gimasur.es necessarily implies the total, prior, and unreserved acceptance by the Customer of the current version of the general terms and conditions of sale at the time of placing the order, which will be materialized by the Customer checking the box “I have read and accept the general terms and conditions” when placing the order.
Description of products and services.
www.gimasur.es provides the Customer with information regarding the basic characteristics of each product or service in the detailed file associated with the product or service in question available on the website.
The descriptions of the products displayed by www.gimasur.es on its website are based on the information provided by the supplier brands.
Price.
Products and services are supplied at the price in effect at the time of placing the order, and are subject to modifications by www.gimasur.es before the order is placed. Prices are indicated in euros with VAT included.
www.gimasur.es currently offers FREE SHIPPING for orders over 180€ (otherwise, shipping costs will be calculated based on the designated delivery location).
Orders.
The order of products or services by the Customer on www.gimasur.es will be made following the different stages of the process provided on the Website, from the selection of the product or service to the payment of the order. Before the final confirmation of their order, the Customer will have access to a summary of it, which will basically contain information about the requested products and services, their price, and any associated costs.
The Customer may modify the content of their order at any time before finally confirming it.
In order to process the order, the Customer agrees to provide, through the forms provided for this purpose, all mandatory data, especially those relating to their identity and contact details.
In case of error or omission in relation to this information, www.gimasur.es cannot be held responsible if the order could not ultimately be processed.
The Customer’s order will not be final until the receipt of its confirmation sent by www.gimasur.es to the email address provided by the Customer, which will be sent once the order is completed.
Order confirmation will be sent to the Customer within a maximum period of twenty-four hours from when the order confirmation page appears on their computer screen.
The order will be processed by www.gimasur.es once online confirmation of payment has been received.
Changes and Returns
Except for the exceptions provided in Article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, the consumer and user shall have the right to withdraw from the contract within a period of 14 calendar days without indicating the reason and without incurring any cost other than those provided for in Articles 107.2 and 108.
Order Cancellation.
The offers of products or services presented on www.gimasur.es are exclusively intended for adult Customers (18 years and older) who meet the specifications contained in previous paragraphs.
Persons who do not meet the criteria set out in these General Conditions.
Persons who do not comply with these General Conditions.
Persons who have not paid and settled previous due invoices to www.gimasur.es , or who maintain with www.gimasur.es a conflict arising from a previous order.
People who make fraudulent use of the Website or payment methods.
Orders that have not been paid within a maximum period of 5 days from their issuance.
Likewise, www.gimasur.es will have the right to cancel all orders placed by a Customer with whom it has a conflict due to a previous order, or if the Customer has breached these general conditions or engaged in fraudulent activity. It may also cancel an order when the Customer has refused to provide any useful and necessary data to guarantee payment and delivery of the products, and for any other legitimate reason.
In case of order cancellation, the Customer will receive an email informing them of this circumstance, and the Customer will not have the right to request or demand any compensation from www.gimasur.es due to said cancellation. www.gimasur.es cannot be held responsible if the email or message is not delivered to the Customer due to an error in the email address or mobile/landline phone number provided by the Customer in their participation form, due to a failure of the access provider, in case of an Internet network failure or for any other reason.
Payment methods.
In the order process, and before confirmation, the Customer will be offered several payment alternatives:
Online payment by credit card. If the customer chooses this form of payment, they will access the bank entity of www.gimasur.es, through a secure payment gateway from which the payment process will be carried out.
Payment via PayPal. By choosing PayPal as the payment method, you will access the PayPal website.
Payment by bank transfer. If the customer chooses to make the payment by bank transfer, at the end of the order a screen will appear informing of the bank entity details, account, and amount to carry out the transfer. Likewise, this data will be automatically provided by email to the address indicated in the order by the Customer. If 4 days have passed since the order was placed with payment by bank transfer without it being made effective, www.gimasur.es will proceed to cancel the order due to non-payment, with the customer receiving a notification by email.
Payment by Redýs card.
Billing.
Once the goods have been delivered to you, you will receive an email notifying you of the closure of the order and the possibility of downloading an invoice for it from the customer area of the website.
Product delivery and service provision.
The delivery of the product and/or performance of the services requested by the Customer through the Internet Site will be carried out through the transport agency.
Shipments: Only mainland shipments.
Shipments will be made through our transport agency, with an approximate delivery time of 2 business days depending on the form of payment and time at which the order is placed.
In case of temporary lack of stock, you will be notified by email of the approximate delivery date. In such case, the customer has the option to cancel the order or only the purchase of the item.
The customer must check upon receipt of the goods that they comply with what was requested. You should never accept shipments with damaged packaging, broken seals, or if you observe that the treatment given could be a reason for the items not to have the necessary quality guarantee. In such case, you should not accept the shipment, proceeding to return it and noting the deficiencies detected.
If it is not possible to make the delivery at the address indicated in the order for reasons beyond the control of www.gimasur.es and the transport agency, the latter will leave a note for collection at their offices. In such case, and after 10 days from the delivery notification without the customer collecting the shipment, it will be returned to the warehouses of www.gimasur.es considering the order cancelled and proceeding with the refund of the amount.
Personal Data.
All Personal Data provided by the Customer will be processed by www.gimasur.es in accordance with the current Data Protection Regulations contained in the website, www.gimasur.es
In this regard, it is expressly stated that www.gimasur.es ensures full compliance with Law 34/2002 on Information Society Services and Electronic Commerce and the current Personal Data Protection regulations, acknowledging that it has adopted or will adopt all technical and organizational security measures that are mandatory in accordance with the provisions of current legislation, in order to guarantee maximum security and confidentiality of communications.
By contracting the products and/or services of www.gimasur.es the Client agrees that their data will be incorporated into a file owned by www.gimasur.es for the purpose of providing the service and billing.
In compliance with the provisions of the current Personal Data Protection Regulations, the Client may exercise their rights of access, rectification, deletion, limitation of processing, portability and opposition of their personal data to the Files of, www.gimasur.es, S.L. by sending a communication to the “Data Controller” at the registered office of www.gimasur.es located at Avda. Los Ángeles, 19 1ºG Loja (Granada). This communication can also be made by sending an email to the address: info@gimasur.es
Force majeure.
www.gimasur.es will be released from its obligations due to any cause beyond its control that prevents or delays the provision of products or services, contractually assimilated to a case of force majeure. For example, this will be the case when any of the following events affect www.gimasur.es or its suppliers: war, cyclone, earthquake, tsunami, flood, general or sectoral strike, or any other cause and event beyond the control of www.gimasur.es (without this list being exhaustive)
Modification of these conditions and duration.
www.gimasur.es may modify at any time the conditions determined here, being duly published as they appear here. The validity of the aforementioned conditions will depend on their exposure and will be in force until they are modified by others duly published.
Applicable legislation.
These conditions will be governed and interpreted by Spanish legislation.
The parties submit, at their choice, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of Granada.
